Driver Convicted To Life Imprisonment

Ebrima Njie, the driver who caused the death of eight students and injured four in June at Conteh Kunda Sukuto road in The North Bank Division was on Thursday 29th September, 2011 convicted and sentenced to life imprisonment for manslaughter and ten years for rash and negligent driving by magistrate Dayoh Small Dago of the Farrafenni Magistrates’ Court.
 Mr. Njie was charged for rash and negligent act causing death contrary to section 221 [a] of the criminal code cap 10 volume 3 revised laws of the Gambia 2009.
 He pleaded guilty to the charges.
Narrating the facts before the court, the police prosecutor Sergeant Ebrima A. Sarr said that the accused person Ebrima Njie, was driving a vehicle with registration number BJL8345G when he ran into a group of twelve (12) students walking along the left side of the road from school going home.
According to him, eight of the students’ loss their lives on the spot while four sustained serious injuries and   were rushed to the AFPRC Hospital in Farrafenni before they were later evacuated to the R.V.T.H in Banjul.
“The four injured were admitted and a postmortem was conducted on the dead students following a request from their parents,” he said.
In his plea of mitigation, Ebrima Njie begged the court to temper justice with mercy saying this is the first time he committed a traffic offence of such a magnitude since he began his career as a driver.  
However, magistrate Dago said he was not convinced because during the proceedings he had to warn the accused person when he smiled, after he, was shown the evidences, which indicated that he, had no regrets so far.
In his judgment, magistrate Small said the prosecutor has proved his case beyond reasonable doubts by taking a close look at the facts and nature of the case, and most especially on the photos of the victims. The prosecutor even went to mention that rash and negligent act caused the death of the eight innocent young children.
“ I  accordingly fine  the accused person Mr. Ebrima Njie guilty of both , rash and negligent act thereby  causing the  death of  eight students to  ten (10) years  imprisonment with hard labour and life imprisonment  for manslaughter,” he said.
The eight victims were: Awa Secka, Omar Secka, Babou Secka, Mariama Secka, Ebou Secka, Basiru Secka, Kodou Cham and Sulayman Bittaye.
