A civil suit Mr Amadou Omar Mbacke, a businessman based in Tallinding instituted against the family of one Tamba Drammeh on Tuesday 14 January proceeded at the magistrates’ court in Bundung presided by Fredrick Foster.
Mr Mbacke wants the court to evict the defendants, who he claims are refusing to vacate a compound he bought from Mr Tamba Drammeh, the family head of the defendants.
In his testimony, the plaintiff explained that he bought the said compound situated at Tallinding in October 2011 and the transfer of ownership was made by Mr Tamba Drammeh after he’d settled the fee charged.
Since then, he added, the two wives and ten children of Mr Tamba have refused to vacate his compound and are not paying rent.
The businessman said he is aware that Mr Tamba had asked his wives and children to vacate the compound, but to no avail as the two wives - Chakunding Ndow and Jankey Janneh, and their ten children insist on staying put unless killed.
“I did not use force on the family,” Mr Mbacke, who is being represented by Lawyer Ousainou Darboe testified. And Darboe attempted to tender the compound document as evidence in court, but Mr Tamba’s elder son, Lamin Drammeh opposed it on grounds that the document does not bear the approval of the Alkalo of Tallinding nor the Kanifing Municipal Council.
Lamin urged the court to grant them a long adjournment for their counsel Hagum Gaye to represent them during the next sitting. His requests were granted and the case resumes March 20.
Meanwhile, the next witness lined up to testify against the defendants is Mr Tamba Drammeh, the man who sold the compound to the businessman and who is the husband to the two wives and father to the ten children on trial.
